Terms and Conditions of Sale

The terms that apply when you buy gaming accessories and video games from RozGamer.co.uk: how ordering works, what you pay, and your rights if you change your mind or something goes wrong.

Please read these terms before you place an order on RozGamer.co.uk. They explain who we are, how we sell products to you, how you and we can change or end the contract, and what to do if there’s a problem. They sit alongside our Delivery & Returns information, our Privacy Policy and our Disclaimer.

About us and these terms

RozGamer.co.uk is an online store selling gaming accessories and video games for PlayStation, Xbox, Nintendo Switch and PC. The website is operated by RozGamer (“RozGamer”, “we”, “us” or “our”).

These terms apply to every order you place on our website as a consumer, meaning you’re buying for personal use rather than for a business. They’re written in English, and contracts with us are concluded in English. If you think there’s a mistake in these terms or something isn’t clear, please contact us before you order.

Using our website

You’re welcome to browse, research and buy on RozGamer.co.uk. When you use the website, you agree not to:

  • use it for anything unlawful or fraudulent, including placing orders with payment details you’re not authorised to use;
  • introduce viruses or other harmful code, or try to gain unauthorised access to the website, its server or any connected system;
  • use bots, scripts or other automated tools to copy content or to buy products, including limited-stock releases;
  • interfere with other people’s use of the website.

We may suspend or restrict access to the website, or to an account, if we reasonably believe these rules have been broken.

Product information and compatibility

We work hard to make product descriptions, specifications and images accurate. Colours can look slightly different on different screens, and manufacturers sometimes update packaging without notice. Every listing names the consoles and models a product supports, and our quick compatibility checks cover the questions we’re asked most often.

Platform holders occasionally release system updates that change how some accessories behave. If a product we describe as compatible with your console doesn’t work with it, that’s covered by your rights under faulty goods below. Our Disclaimer explains the limits of the general guides and advice on our website.

Availability and links

We aim to keep the website available at all times but can’t guarantee it will always be uninterrupted or error-free. We may update or change it, for example to add products or reflect changes in the law. Where we link to other websites, such as manufacturer support pages, those links are for information only and we aren’t responsible for their content. Our Privacy Policy explains how we use personal data and cookies.

Your account

You must be 18 or over to place an order with us. If you create an account on RozGamer.co.uk:

  • keep your password private and don’t share your login with anyone else;
  • keep your name, email address and delivery address up to date so your orders reach you;
  • tell us straight away if you think someone else has used your account without permission.

We may suspend or close an account if we reasonably believe it’s being used fraudulently or in breach of these terms, and we’ll tell you why where we’re able to. You can ask us to close your account at any time. Closing an account doesn’t affect orders you’ve already placed or your legal rights in relation to them.

Placing an order and when the contract is made

How ordering works

  1. Add the products you want to your basket, checking that each one lists your console or device as compatible.
  2. At checkout, enter your delivery details and choose a delivery option. You’ll see the full price, including any delivery charge, before you pay.
  3. Review your order. You can go back and correct any mistakes in your basket or details at any point before you submit it.
  4. Submit your order and pay. By doing this you’re offering to buy the products on these terms.

Order acknowledgement and dispatch confirmation

After you submit your order, we’ll email you an order acknowledgement. This confirms we’ve received your order, but it doesn’t mean we’ve accepted it yet. Our acceptance, and the contract between you and us, happens when we email a dispatch confirmation telling you the products are on their way. If we supply a digital code by email, the contract for that code is made when we send it.

If your order is sent in more than one parcel, each dispatch confirmation forms a contract for the items it lists. Please quote your order number whenever you contact us. We keep a record of your order and the version of these terms that applied to it, and you can ask us for a copy at any time. Your order details are also included in the emails we send you, and we recommend saving or printing a copy of these terms for your records.

If we can’t accept your order

We’ll let you know as soon as possible and won’t charge you, or we’ll refund you in full, if we can’t accept your order. This might happen because:

  • the product is out of stock or has been discontinued;
  • there’s an error in the price or description (see prices);
  • we can’t deliver to your address;
  • we can’t confirm your age for an age-restricted game, or can’t verify your payment details;
  • the order is for an unusually large quantity. We may limit how many of an item each customer can buy, particularly new releases and limited stock, so more players get a fair chance.

Pre-orders

Where we offer a product on pre-order, the product page shows its expected release date. Release dates are set by publishers and manufacturers and sometimes change. If a date moves, we’ll let you know, and you can cancel your pre-order for a full refund at any time before it’s dispatched. We’ll tell you at checkout when payment for a pre-order is taken.

Prices

  • All prices are in pounds sterling (£).
  • Delivery charges, where they apply, are shown at checkout before you pay. The total on the final checkout screen is the total you pay.
  • Prices can change, but a change won’t affect an order you’ve already placed, other than to correct a pricing error as explained below.

Pricing errors

Despite our best efforts, a product may occasionally be listed at the wrong price. We check prices when we process your order. If the correct price is lower than the price shown, we’ll charge you the lower amount. If it’s higher, we’ll contact you before dispatch to ask whether you’d like to go ahead at the correct price or cancel for a full refund. If a pricing error is obvious and unmistakable, and could reasonably have been recognised by you, we don’t have to supply the product at the incorrect price, even if we’ve accepted your order.

Payment

  • The payment methods we accept are shown at checkout. We don’t add a surcharge for paying by card.
  • Payment is taken, or authorised, when you place your order. If we can’t accept your order, we’ll cancel the payment or refund it in full.
  • Payments are processed over a secure, encrypted connection. We may carry out checks to help prevent fraud, and if we can’t verify your payment or details we may cancel the order and refund you. Our Privacy Policy explains how your data is used for this.
  • If we offer discount or promotional codes, they can only be used in line with their stated conditions and can’t be exchanged for cash.

Delivery

We deliver across the UK. Our Delivery & Returns page explains where we deliver, whether your chosen service is tracked, and what to do about missed, damaged or missing parcels. Delivery options, costs and estimated delivery times are shown at checkout before you pay.

  • Timing. Estimated delivery times are a guide. Unless we agree a delivery date with you, we’ll deliver without undue delay and no later than 30 days after the contract is made, as required by the Consumer Rights Act 2015.
  • Late delivery. If we miss the delivery deadline and you told us before ordering that delivery by then was essential, you can end the contract straight away and get a full refund. Otherwise, you can give us a further reasonable period to deliver, and end the contract for a full refund if we miss that too.
  • Responsibility. Products are our responsibility until they’re delivered to you, or to someone you’ve nominated to receive them. You own the products once we’ve received payment in full.
  • Your address. Please check your delivery address carefully. If you spot a mistake after ordering, contact us as soon as possible and we’ll do our best to correct it before dispatch.

Your right to cancel

Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you can cancel most online orders without giving a reason. The cancellation period starts when you place your order and ends 14 days after the day you, or someone you nominate, receive the products. If your order arrives in separate parcels, the 14 days run from the day after you receive the last one.

How to cancel

Tell us clearly that you want to cancel before the 14 days are up by emailing support@rozgamercouk.com with your name, order number and the items you’re cancelling. You can use the model cancellation form if you like, but you don’t have to. If you cancel before your order is dispatched, we’ll stop it and refund you in full.

Returning the products

Once you’ve told us you’re cancelling, you have 14 days to send the products back. Unless the item is faulty or we sent you the wrong item, you’ll need to cover the cost of return postage. We recommend a tracked service and keeping your proof of postage. The returns process sets out each step.

You can open and check a product in the way you would in a shop, for example pairing a controller to see that it connects. If a product has been handled or used more than that, or comes back damaged or with parts missing, we may reduce your refund to reflect the loss in value.

Your refund

  • We’ll refund you within 14 days of the day we receive the products back or the day you give us evidence that you’ve sent them, whichever is earlier. If we haven’t dispatched your order yet, we’ll refund you within 14 days of you telling us you’re cancelling.
  • If you cancel your whole order, your refund includes the delivery charge you paid, up to the cost of our cheapest standard delivery option.
  • We’ll refund you using the same payment method you used to pay, and we won’t charge you a fee for doing so.

When the right to cancel doesn’t apply

The law sets out some exceptions. You can’t cancel for a change of mind once:

  • you’ve unsealed a sealed video game, piece of software or audio or video recording after delivery;
  • a product has been personalised or made to your specification, where we offer this;
  • you’ve unsealed an item that was sealed for health protection or hygiene reasons and isn’t suitable for return once opened, such as hygiene-sealed in-ear earbuds;
  • you’ve started downloading or redeemed digital content, such as a download or subscription code, where you gave your express consent to that happening during the cancellation period and acknowledged that you’d lose your right to cancel.

These exceptions only apply to change-of-mind cancellations. If any of these items is faulty or not as described, your rights under the Consumer Rights Act 2015 still apply in full.

Faulty or incorrectly described goods

We’re under a legal duty to supply products that match their description, are of satisfactory quality and are fit for purpose. The Consumer Rights Act 2015 gives you these remedies if something is wrong:

Depending on the product and how long it could reasonably be expected to last, you may still have rights for up to six years from delivery (five years in Scotland). We’ll cover the reasonable cost of returning a faulty item, and if you use your short-term right to reject, we’ll refund you in full within 14 days of agreeing that you’re entitled to it.

Normal wear and tear, accidental damage, misuse, unauthorised repairs or modifications, and problems caused by not following the manufacturer’s instructions aren’t faults. An accessory that doesn’t work with a console it isn’t listed as compatible with isn’t faulty either, unless we told you before you ordered that it would work with your console: if you told us your exact console or device and we said the product would work with it, it has to. Either way, you can still return an accessory that isn’t right for your setup under your right to cancel.

Many products also come with a manufacturer’s warranty or guarantee. This is in addition to your legal rights and doesn’t replace or reduce them. To report a fault, see faulty or wrong items on our Delivery & Returns page.

Age-restricted games

Video games sold in the UK carry a PEGI age rating of 3, 7, 12, 16 or 18, along with content descriptors for things like violence, bad language and in-game purchases. Ratings of 12, 16 and 18 are legally enforceable in the UK, so it’s against the law for us to sell a game with one of these ratings to anyone under that age. PEGI 3 and 7 are advisory.

  • By ordering an age-rated game, you confirm that you’re at least the age shown on its rating.
  • We may ask for proof of age before we dispatch an age-restricted game, and we may refuse or cancel an order, with a full refund, if we can’t confirm that the buyer is old enough.
  • If you’re buying for a child, please check the rating and content descriptors first. Every game in our video games range shows its PEGI rating.

Our liability to you

If we fail to comply with these terms, we’re responsible for loss or damage you suffer that is a foreseeable result of our breaking this contract or failing to use reasonable care and skill. Loss or damage is foreseeable if it’s obvious it will happen, or if both you and we knew it might happen when the contract was made. We aren’t responsible for loss or damage that isn’t foreseeable.

We don’t exclude or limit our liability to you where it would be unlawful to do so. This includes liability for:

  • death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors;
  • fraud or fraudulent misrepresentation;
  • breach of your legal rights in relation to the products, including the right to receive products that are as described, of satisfactory quality and fit for purpose;
  • defective products under the Consumer Protection Act 1987.

We supply products for domestic and private use only. If you use them for commercial, business or resale purposes, we have no liability to you for loss of profit, loss of business, business interruption or loss of business opportunity. If defective digital content we supplied damages a device or other digital content belonging to you, we’ll either repair the damage or pay you compensation, unless you could have avoided the damage by following our advice or the manufacturer’s instructions.

Please follow the manufacturer’s instructions for every product, especially chargers, battery packs and anything else that plugs in. Electrical Safety First has useful advice on using electrical products safely.

Events outside our control

We aren’t responsible for delays or failures caused by events outside our reasonable control, such as severe weather, courier or postal disruption, industrial action, supplier or manufacturer shortages, power or internet outages, fire, flood or government action. If one of these events affects your order, we’ll contact you as soon as possible and do what we can to reduce the delay. If the delay is likely to be substantial, you can contact us to end the contract and receive a refund for any products you’ve paid for but not received.

Intellectual property and trademarks

The content of RozGamer.co.uk, including its text, design, illustrations, graphics and the RozGamer name and logo, is owned by or licensed to us and protected by copyright and other intellectual property laws. You may view, download and print extracts for your own personal use, but you mustn’t copy or reuse our content for commercial purposes without our written permission.

PlayStation, PS5, PS4, DualSense and PS VR2 are registered trademarks or trademarks of Sony Interactive Entertainment Inc. Xbox, Xbox Series X|S and Xbox One are trademarks of the Microsoft group of companies. Nintendo Switch and Joy-Con are trademarks of Nintendo. Other product and brand names belong to their respective owners.

RozGamer.co.uk is an independent retailer and isn’t affiliated with, sponsored by or endorsed by Sony Interactive Entertainment, Microsoft or Nintendo. We use brand and platform names only to identify the products we sell and the consoles they work with.

Governing law and disputes

These terms are governed by the law of England and Wales, and you can bring legal proceedings about them in the courts of England and Wales. If you live in Scotland, you can bring proceedings in either the Scottish or the English courts. If you live in Northern Ireland, you can bring proceedings in either the Northern Irish or the English courts.

If you have a complaint, please contact us first so we can try to put things right quickly. If we can’t resolve it, we’ll explain your options. Citizens Advice offers free, impartial guidance on consumer rights in England and Wales, as does Consumer Advice Scotland in Scotland and Consumerline in Northern Ireland. Changes to these terms and other important terms

We may update these terms from time to time, for example to reflect changes in the law or in how we run our store. The date at the top of this page shows when they were last updated. The version that applies to your order is the one published on our website when you placed it.

  • Transferring the contract. We may transfer our rights and obligations under these terms to another organisation. If we do, we’ll tell you in writing and make sure the transfer doesn’t affect your rights. You may only transfer your rights to someone else if we agree in writing.
  • Third parties. This contract is between you and us. Nobody else has any right to enforce its terms under the Contracts (Rights of Third Parties) Act 1999.
  • Each term stands alone. If a court decides that part of these terms is unlawful, the rest will remain in full force.
  • Delays in enforcing. If we don’t insist straight away that you do something you’re required to do under these terms, we can still insist on it later.
